These general and specific rental terms and conditions (hereinafter the “Terms”) govern the seasonal rental of the holiday house “Le Colombier,” located at Château de Scandaillac, 47210 Saint-Eutrope-de-Born, France, offered for online booking by Purple Haven Sarl (hereinafter the “Landlord”).
Before proceeding to pay the deposit on the online booking form, the Tenant is asked to read these Terms in full and to check the box provided for this purpose, confirming that they have read and unconditionally accept them. Checking this box, followed by payment of the deposit, constitutes full and unconditional acceptance of these general and specific rental terms and conditions, without any handwritten or electronic signature being required. Upon completion of the booking, a rental contract setting out the specific terms of the stay (dates, rate, number of occupants, etc.) as well as these general terms will be sent to the Tenant by email.

PART I – SPECIFIC CONDITIONS
2. Scope
These specific conditions apply to the seasonal rental of the following property:

The stay dates, number of occupants, total rate, and the amount of the deposit, balance, and security deposit are specified during the online booking process and confirmed in the rental contract sent after payment.
3. Booking and payment
The booking of the property was made by the Tenant online, via the Landlord’s website. It was confirmed by payment, at the time of booking, of a deposit corresponding to 50% of the total stay amount.
The balance of the stay amount, as well as the security deposit, are paid online no later than 4 weeks before the arrival date.
Failure to pay the balance and the security deposit within this timeframe will result in cancellation of the rental and forfeiture of the deposit already paid. Any late payment must be expressly notified to the Landlord.
4. Price and tourist tax
The price of the stay includes the cleaning fee and the tourist tax.
Calculated per person, the tourist tax amounts to €0.86 per person per night. The tourist tax is a local tax that the Tenant must pay to the Landlord, who then remits it to the public treasury.
5.Security deposit
The security deposit is paid online together with the payment of the balance of the rental, no later than 4 weeks before the arrival date.
It covers any damage or deterioration to the property, as well as damage, loss, or theft affecting the furniture and movable property in the accommodation during the rental period.
In the absence of damage, the security deposit will be refunded to the Tenant within a maximum of 7 days after departure, by bank transfer.
Where rental damage exists, the security deposit will be refunded within a maximum of 2 months, after deduction of the costs incurred in repairing the damage sustained. However, should the amount of the deposit prove insufficient, the Tenant will be asked to make up the difference.
PART II – GENERAL CONDITIONS
6. General provisions
The parties agree that the rental covered herein is a seasonal rental, the duration of which may not exceed 90 days. The Landlord declares that they own the property and have free disposal and full enjoyment of it during the rental period defined herein. The Landlord may prove ownership of the property by providing the supporting documents requested by the Tenant. Under no circumstances may the Tenant claim any right to remain on the premises after the rental period initially provided for in this contract expires, unless agreed by the Landlord.
7. No Right of Withdrawal
Pursuant to Article L. 221-28, 12° of the French Consumer Code, accommodation services provided on a specified date are not subject to the 14-day withdrawal right applicable to contracts concluded at a distance. Consequently, a booking made online cannot be withdrawn from; only the cancellation terms set out in Article 8 below apply.
8. Cancellation Terms
The rental is final, and neither the Tenant nor the Landlord may withdraw from it, except under the cancellation terms provided for the Tenant in the contract, or in the event of force majeure.
If the Landlord cancels the rental due to force majeure, they must refund the full amount of all sums paid.
If the Tenant fails to pay the balance of the stay amount and the security deposit by the deadline, i.e. no later than 4 weeks before the start of the stay, the contract is deemed terminated: the deposit paid remains the property of the Landlord, who will not refund it and may make the rental available again. Any late payment must be expressly notified to the Landlord.
To be valid, any cancellation request made by the Tenant by phone or email must be confirmed by the Tenant by registered letter, the postmark date serving as proof. The Landlord may also acknowledge the cancellation request by return email.
If the Tenant cancels the rental, the full rental amount is owed to the Landlord.
9. Insurance
The Tenant is required to take out holiday-let insurance for the rented property. The Tenant should therefore check whether their primary home insurance policy includes a holiday-let extension (holiday rental). If not, they must contact their insurance company to request an extension of coverage, or take out a specific policy under a “holiday let” clause.
10. Landlord’s Obligations
The Landlord undertakes to keep the property covered by this contract in a satisfactory state of upkeep, cleanliness, and safety. They undertake to notify the Tenant as soon as possible of any change beyond their control likely to affect comfort or disturb enjoyment of the rented property (nuisance, equipment failure, etc.). Should any appliance or equipment with a major impact on the Tenant’s comfort fail, the Landlord undertakes to use all means to arrange repair or replacement as soon as possible. They must ensure that the Tenant enjoys full and complete use of the rented property throughout the period. They will arrange for the handover of keys and will refrain from disturbing the Tenant’s comfort or peace during the stay.
11. Tenant’s Obligations
The Tenant shall make peaceful use of the rented property. They shall maintain the rented property and return it in a clean condition. They must respect the neighbours as well as the house’s internal rules. They undertake to make normal and reasonable use of the comfort features (heating, air conditioning, water, etc.) and of the equipment (pool, appliances, multimedia, kitchen, etc.) made available to them. They are forbidden from making copies of the keys provided by the Landlord. They undertake to inform the Landlord as soon as possible of any breakdown, damage, incident, or malfunction. The Tenant is responsible for the use of the internet access made available to them during the rental period.
12. Termination
Should the Tenant fail to comply with any of their contractual obligations, this contract will be terminated automatically. This termination will take effect 48 hours after a simple formal notice sent by registered letter or hand-delivered letter that has gone unanswered.
13. Assignment and Subletting
This seasonal rental contract is entered into solely for the benefit of the Tenant. Assignment of the contract, as well as full or partial subletting, are strictly prohibited.
14. Length of Stay
The Tenant, as a party to this fixed-term contract, may under no circumstances claim any right to remain on the premises.
15.Number of Occupants
This contract is drawn up for a specific number of people. The number of occupants may not exceed the capacity stated in the property description. The Tenant expressly undertakes not to exceed this number without the Landlord’s authorization. If the Landlord agrees, they may request an additional fee per extra person. The Landlord is entitled to refuse additional occupants; this refusal can in no case be considered a modification or breach of the contract on their part, so that no refund may be claimed if the number of people who leave exceeds the number that was refused.
16.Pets
Pets are allowed in the property. The Tenant undertakes to ensure the cleanliness and good behaviour of their pet throughout the stay. They remain responsible for any damage, deterioration, or nuisance caused by it; the cost of any repairs may be deducted from the security deposit.
17. Non-Smoking Property
For hygiene and safety reasons, the property is non-smoking. In the event of non-compliance, any decontamination costs will be charged to the Tenant.
18. Arrival / Departure and Handover of Keys
The Tenant must arrive on the specified day, between 4:00 p.m. and 7:00 p.m. In the event of a late or delayed arrival, the Tenant must notify the Landlord. Departures must take place before 11:30 a.m.
The Landlord and the Tenant agree on the following arrangements for the handover of keys: keys handed to the Tenant in person upon arrival, and keys handed to the Landlord in person upon departure.
19. Property Inspection
A property inspection is carried out by the concierge service on each departure. The Tenant has 24 hours from arrival to report any issue.
20. Linens and Cleaning
Bed linens are provided and the beds are made upon arrival. Bath linens, bath sheets, and towels are provided. End-of-stay cleaning is included, with the exception of the kitchen, which must be cleaned by the Tenant (dishes washed, dishwasher emptied, bins taken out). The included cleaning package covers standard end-of-stay cleaning (floors, bathrooms, kitchen, etc.), but does not cover a full restoration in the event of a total lack of upkeep during the stay; an additional fee is charged in that case.
21. Protection of Personal Data
The personal data provided by the Tenant when booking (identity, contact details, payment information) is collected by the Landlord solely for the purposes of managing the booking, the contractual relationship, and compliance with its legal obligations, particularly tax obligations. In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the Tenant has the right to access, rectify, erase, and object, which they may exercise with the Landlord at the email address indicated in Article 1.
22. Governing Law and Disputes
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts shall be those with jurisdiction over the registered office of Purple Haven Sarl.
23. Acceptance of the Terms
This document is concluded without a signature. The checkbox validated by the Tenant on the online booking form, confirming that they have read these general and specific rental terms and conditions, together with payment of the deposit, constitutes full and unconditional acceptance thereof.
